Snow+Snow’s Robert Langston told E&E News that he would be surprised if the new administration pursues an effort to revoke the foundational federal determination that greenhouse gas emissions endanger public health, calling the legal and political risks significant.
“Even conservative-leaning judges have acknowledged in written opinions that climate change is a genuine public health concern,” Langston said. “Going after the underlying scientific determination is a different category of legal exposure than rolling back individual rules.”
He added that the new administration has a full agenda of more actionable deregulatory priorities. “There are dozens of specific rules and permitting processes that can be reformed within existing statutory authority. Spending political capital on the most contested possible fight would crowd out a lot of more achievable wins.”
