Snow+Snow’s Marcus Webb told The National Law Journal that the SEC’s newly announced cryptocurrency task force represents a meaningful departure from the prior administration’s approach of using enforcement actions as the primary tool for shaping crypto market regulation.
“This is an acknowledgment that enforcement-first wasn’t working as a policy framework,” Webb said. “You can’t create durable regulatory clarity by bringing cases — you need actual rules. The industry has been asking for that for years and it looks like they may finally be getting it.”
Webb noted that the shift creates new opportunities and responsibilities for legal counsel advising crypto platforms and issuers. “Clear rules cut both ways. Clients will have less ambiguity to hide behind, but they’ll also have a real compliance framework to point to. That’s a better place to operate from.”
